https://ac-systems.be is a website published by the company A&C Systems NV, having its registered office at Bleyveldstraat 16A, 3320 Hoegaarden, Belgium, entered with the Crossroads Bank for Enterprises under number 445.299.482 (hereinafter referred to as "A&C").

The company A&C Systems S.A. can be contacted by calling +32 16 30 21 21 or by sending an e-mail to info@ac-systems.com.

A&C Systems S.A. is the data controller for the personal data collected through the Website.

The Internet site https://ac-systems.be (the Website) is hosted by the company A&C Systems NV, having its registered office at Bleyveldstraat 16A, 3320 Hoegaarden, Belgium.

The Website is the exclusive property of A&C.

2. What personal data are collected through the Website?

In addition to cookies (see applicable cookie policy), A&C only collects personal data specifically and voluntarily provided by the user of the Website or that it receives from third-party sources by processing Website user requests ("the personal data of the user"). For each user, this Policy only applies to the personal data of the user.

In addition to cookies (see applicable cookie policy), you may use the Website without providing any personal data to A&C. However, you cannot enter into a contract with A&C without providing any personal data.

The personal data of the user may include:

  • identification data (name, maiden name and last name, e-mail address and phone number, smartphone IMEI code, home address, date of birth, national identification number, personal identification code, gender, marital status, photographs, citizenship, passport data, identity card data, etc.)
  • technical data (the Website automatically collects certain non-identifiable information about its users, such as the Internet Protocol (IP) address of the computer, the IP address of the Internet Service Provider, the date and time the user accessed the Website, the Internet address of the site from which the link was established directly with the Website, the operating system used, the sections of the Website visited, the pages of the Website visited and the data consulted, as well as the information that the user posts or downloads from the Website)
  • banking data (name of financial institutions, bank account numbers, status of accounts, credits, accounts, etc.)
  • administrative data (VAT number, data useful for managing user requests, etc.)
  • all personal data provided to A&C by the user of the Website such as, for example, logins and passwords used to access the Website.

A&C also collects any personal data that the user enters in any message sent to A&C and its representatives or members.

A&C does not collect sensitive personal data (such as personal data that reveal racial or ethnic origin, political opinions, religious or philosophical beliefs or union membership, as well as data concerning the health of a natural person). If necessary, A&C will ask users to provide their explicit consent to the collection and use of such sensitive data.

3. Who collects these personal data?

The personal data are collected by A&C Systems S.A..

Personal data may in particular be obtained in the following situations:

  • When the user provides personal data to A&C, or when the user interacts with A&C directly (by e-mail, phone or mail);
  • When the user enters into a contract with A&C;
  • When A&C manages its technological tools and services, including visits to its Website and e-mails sent to A&C;
  • When A&C collects personal data from other sources, such as lawyers, co-contractors, official registers, commercial databases or using public sources.

4. Data obtained automatically 

4.1 Technical data 

Like many other websites, this Website automatically collects certain non-identifiable data about its users, such as the Internet Protocol (IP) address of the computer, the IP address of the Internet Service Provider, the date and time the user accesses the Website, the Internet address of the site from which a link was established directly to this Website, the operating system used, the sections of the Website visited, the pages of the Website the user visited and the data consulted, as well as the information that the user posts or downloads from the Website. This technical data is used for the purposes of the Website and system administration, and for the improvement of the Website. It may be disclosed to third parties and permanently archived for future use.

4.2 Cookies and web beacons

In order to ensure the proper management of the Website and to enable optimal navigation of the Website, A&C or third parties may use cookies (small text files stored in the user's browser) or web beacons (electronic images that allow the site to count the number of users who have accessed a specific page or certain cookies) to collect aggregate data. A&C will only use these tools in accordance with the Cookie Policy as posted on the Website.

A&C's cookies and web beacons do not collect any personal information (such as a user's name or e-mail address). In addition, users have the option in most browsers to disable cookies. However, in specific cases, users may not be able to access certain areas of our site if their browser is set to refuse cookies.

5. What are the purposes of processing these personal data?

5.1. General purposes

The processing of personal data described in this Policy is necessary for the management of the user's requests and for A&C to comply with its legal obligations.

The purpose of processing personal data voluntarily communicated by users to A&C is primarily to enable A&C to respond to users' requests.

Subject to applicable legal restrictions, A&C uses personal data for the following purposes.

  • A&C uses personal data to comply with its obligations regarding the management of user requests.
  • A&C uses personal data to perform a contract entered into with the user.
  • A&C also uses personal data to comply with its legal obligations, such as in respect of money laundering, and to comply with legal requirements such as income taxes and levies of social security contributions, obligations of record keeping and reporting, conducting audits, complying with government inspections and other requests from the government or other public or regulatory authorities, and complying with internal rules and procedures.

In particular and in a non-exhaustive manner, A&C processes personal data to

  • process and respond to requests, queries or complaints received from the user;
  • manage and administer the relationship between A&C and the user;
  • comply with legal and regulatory requirements;
  • provide the products and services requested by the user;
  • communicate with the user about products and services;
  • make available and improve the Website by generating statistics on the use of the Website;
  • initiate, pursue or defend any legal action involving A&C or its affiliates.

A&C may use non-personal data to create general tracking data reports regarding user demographics and Website usage. A&C may then share these reports with third parties.  None of the tracking data collected in these reports can be linked to the identity or other personal data of individual users, only anonymised data. The third parties with whom A&C shares this anonymised data are clients of A&C for whom A&C sets up IT platforms.

5.2. Direct marketing and communication to third parties

A&C may use the user's personal data for direct marketing purposes if the user has given their prior consent to this effect to A&C.

Once the user has given their consent to A&C, they remain free to refuse certain services at any time. The law provides that the user has the right to object, on request and free of charge, to the processing of their personal data for direct marketing purposes. To do so, users can simply communicate this objection to the A&C Customer Care team via e-mail (webmaster@ac-systems.com), or by post to A&C Systems NV, Bleyveldstraat 6, 3320 Hoegaarden, Belgium or by phone on +32 16 21 30 30.

A&C does not currently carry out any profiling activities. A&C does not use sensitive personal data to classify customers into different categories and to implement targeted mailing campaign on the basis of the classifications made.

6. What are the grounds for the processing of personal data?

A&C processes the personal data of users on the basis of their consent and, where applicable, on the following grounds as appropriate: (i) entering into and performing a contract; (ii) complying with legal and regulatory requirements; (iii) a legitimate interest (e.g. managing and administering the relationship with customers and suppliers).

7. Who has access to personal data?

In providing its services and managing the company and its relationships with customers and third parties, A&C may need to share personal data with individuals working within the company as an employee or independent contractor.  A&C may also need to allow its suppliers and sub-suppliers access to personal data when performing services on behalf of A&C (primarily to maintain and support IT systems) and to public authorities, courts, government agencies and law enforcement agencies.

A&C is authorised to share personal data with third parties where it believes that this is necessary to comply with a legal or regulatory obligation, or to protect its rights or the rights of third parties or the user.

A&C may entrust all or part of the processing of personal data to data processors. Where A&C engages a third-party processor to process personal data on its behalf, A&C will delegate such processing in writing, select a processor that provides sufficient guarantees with respect to the technical and organisational security measures governing the processing concerned and in accordance with the instructions of A&C. In addition, A&C will request appropriate data protection and information security requirements from these third-party processors.

In principle, A&C does not transfer personal data outside the European Union or the European Economic Area. If such a transfer of personal data outside the European Union or the European Economic Area is carried out on the initiative of A&C, such transfer will be carried out in accordance with applicable data protection laws and in particular, such transfer will be carried out in accordance with the standard contractual clauses established by the European Commission in force at the time.

8. Security of personal data

A&C undertakes, as an obligation of means, to take all useful precautions and to implement appropriate technical and organisational measures in this respect to guarantee an appropriate level of security and to protect the personal data of users against alteration, destruction and unauthorised access. As this is an obligation of means, A&C cannot absolutely guarantee that no breach of personal data will occur, but A&C will, if necessary, take the legal measures applicable in such a situation.

In particular, A&C implements appropriate computer security measures to prevent unauthorised access, alteration and destruction of users' personal data. A&C also ensures that its staff members who process users' personal data are subject to an obligation of confidentiality.

9. User’s warranty

The user warrants to A&C that they have the full capacity to authorise the collection and processing of the personal data they communicate to A&C. If the user communicates personal data of third parties to A&C, the user warrants to A&C that they have obtained the consent of the data subject or that they have duly invoked another legitimate cause for the collection and processing of this personal data by A&C. The user will indemnify A&C for any direct or indirect damage of any nature whatsoever resulting from any violation of the provisions of this Policy regarding personal data that may be attributable to the user.

10. Other Websites 

The Website may contain links to other websites or Internet resources. By clicking on one of these links, the user enters another website or Internet resource that may collect data about the user, whether voluntarily provided by the user or obtained through cookies or other technologies. A&C has no control over, and will not be responsible for, any contact with such other websites or Internet resources, or their obtaining, using or disclosing of the user's personal data. A&C recommends that users consult the privacy policies of those other websites and Internet resources to understand how they collect and use data.

11. Retention of personal data

A&C will retain personal data for 7 years from the last interaction with the user. In addition, A&C reserves the right to retain the user's personal data if applicable legal provisions require such retention or if such retention is necessary to enable A&C to bring or defend legal claims. In particular, if the user enters into a contract with A&C, A&C will retain the user's data for eight years from the year after the contract is entered into. As a vendor, A&C is under obligation to be able to present the basic billing data for at least eight years after the billing. However, this should not be a cause for concern for the user, as A&C makes every effort to protect personal data with modern technology.

12. Rights related to personal data

To the extent required by the applicable law, the user (you) may exercise the rights set forth below with regard to your personal data processed by A&C:

  • The right to information: you can ask us whether we are processing your personal data, what data we process, its origin, the purposes of the processing and the identity of the controller.
  • The right of access: you have the right to access the data collected about you. This includes your right to request and obtain a copy of your personal data processed by A&C.
  • The right to rectification: you have the right to request the rectification of your personal data that are inaccurate or incomplete.
  • The right to erasure: you can request that your personal data be erased from our archives when the conditions are met.
  • The right to restrict the processing: in certain situations, you have the right to have the processing of your personal data by A&C restricted.
  • The right to object to the processing: you have the right to object, in certain situations, to the processing of your personal data.
  • The right to object to automated processing: you have the right to object to the automated processing of your personal data and not to be subject to a decision based solely on the automated processing of your personal data.
  • The right to data portability: you have the right to obtain your personal data in a machine-readable format or, as far as possible, by direct transfer from one computer to another.

If necessary, you have the right to lodge a complaint with the local data protection authority concerning the collection and processing of your personal data by A&C.

14. Policy updates

A&C reserves the right to change this privacy policy at any time without notice and the user is responsible for checking the privacy policies each time they visit the Website. If the user continues to use the Website notwithstanding the changes made to the Privacy Policy, they are deemed to have accepted these changes.

15. Applicable law and jurisdiction

Any use of the Website and this Privacy Policy are governed by the laws of Belgium, without regard to its conflict of laws principles.

Any dispute arising out of or in connection with the Website or this Privacy Policy which has not been informally resolved shall be finally settled by the exclusive jurisdiction of the competent courts of Brussels, using French as language of the proceedings, without prejudice to the jurisdiction of the competent national data protection authority, if applicable, and unless A&C chooses to submit the dispute to the courts of the registered office/domicile of the user or the person they represent.

Notwithstanding anything to the contrary in this Privacy Policy, A&C may seek injunctive and provisional relief from any court of competent jurisdiction (in any state) or from any national data protection authority for any actual or alleged breach of this Privacy Policy.
